PLY CARTEL – Terms & Conditions

By accessing or making a purchase from PLY CARTEL (the “Site”), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Site or place orders.

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. We may update these Terms at any time. Your continued use of the Site after changes constitutes acceptance of the updated Terms.

  

1. Eligibility

You represent that you are at least the age of majority in your jurisdiction (or have parental/guardian consent) and have the legal capacity to enter into these Terms and make purchases.

  

2. Products, Availability & Descriptions

All products are subject to availability. We reserve the right to limit, modify, or discontinue any product or order at any time without notice.

We strive for accurate images, colors, and descriptions, but we do not guarantee that your screen will display them exactly as the physical product.

 

2A. California Proposition 65 Warning 

Some products sold on this Site may contain chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm.

  

3. Pricing & Payment

Prices are in USD and subject to change without notice. We accept payments through Shopify Payments and approved processors.

We reserve the right to correct pricing errors and cancel or refuse orders placed at incorrect prices before shipment.

  

4. Order Acceptance

Your order placement is an offer to purchase. We accept it only when we ship the item(s). We may cancel orders for any reason, including suspected fraud or errors.

  

5. Shipping & Delivery

Orders ship via carriers such as UPS (domestic) and EMS or equivalent (international). Shipping times are estimates only and not guaranteed.

Risk of loss or damage transfers to you once the order is handed to the carrier. We are not responsible for delays, loss, or damage during transit.

International customers are responsible for all customs duties, taxes, and import fees.

  

6. Returns & Refunds

All sales are final. We do not accept returns or exchanges for change of mind, fit, size, or buyer’s remorse. We will only consider replacements or refunds for items that arrive damaged or defective. You must contact us within 7 days of delivery with clear photos and proof of the issue. This policy does not apply to defective products where consumer protection laws require repair, replacement, or refund.

 

6A. Warranty Disclaimer Except where prohibited by law, PLY Cartel disclaims all implied warranties, including the implied warranties of merchantability and fitness for a particular purpose. Products are sold “as is” and “with all faults.” This disclaimer does not limit any rights you may have under California law.

  

7. Chargebacks & Payment Disputes

If you have an issue with your order, please contact us first so we can resolve it directly.

We reserve the right to provide order records, shipping confirmation, and communication logs to payment processors or banks in response to any chargeback or dispute.

  

8. Skateboarding Risk Notice

Skateboarding is an inherently dangerous activity that can result in serious injury or property damage. Our products are not safety equipment and do not prevent injury. By purchasing or using our products, you acknowledge these risks and voluntarily assume full responsibility for any injury, damage, or loss that may occur. PLY CARTEL is not liable for injuries or damages arising from skateboarding activities, except where required by law for defective products.

  

9. Prohibited Uses

You agree not to:

•  Engage in fraudulent, illegal, or harmful activity

•  Use bots, scripts, or automated tools to place orders

•  Interfere with the Site’s security or functionality

•  Upload malicious code or attempt unauthorized access

•  Violate any applicable laws

We may suspend or terminate your access for violations.

  

10. Intellectual Property

All content on the Site (logos, designs, images, text, graphics, etc.) is owned by PLY CARTEL or its licensors and protected by intellectual property laws. Some designs may involve artist collaborations — rights remain with the respective owners and are used with permission.

You may not copy, reproduce, or use any content without our prior written permission...10A. User-Generated Content If you submit artwork, designs, or other content for custom products, you represent that you own all necessary rights to that content. You grant PLY CARTEL a non-exclusive, royalty-free license to reproduce and use the content solely to fulfill your order.

  

11. Limitation of Liability

To the maximum extent permitted by law, the Site and products are provided “as is” and “as available,” without warranties of any kind. PLY CARTEL is not liable for indirect, incidental, consequential, or punitive damages, including (but not limited to) shipping delays, carrier issues, product misuse, or injuries from skateboarding activities. This limitation does not apply where prohibited by California law, including liability for defective products.

  

12. Indemnification

You agree to indemnify and hold PLY CARTEL harmless from any claims, losses, or damages arising from your violation of these Terms, misuse of products, or skateboarding-related activities.

  

13. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control (e.g., strikes, natural disasters, supply chain issues, or carrier problems).

  

14. Severability & No Waiver

If any part of these Terms is found invalid, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right.

  

15. Governing Law & Disputes

These Terms are governed by California law. Any disputes will be resolved exclusively in the courts located in California..

15A. Arbitration Agreement Any dispute arising out of these Terms or your use of the Site will be resolved through binding arbitration in California, rather than in court. Class Action Waiver: You agree to resolve disputes only on an individual basis and not as part of any class, consolidated, or representative action. This section does not apply where prohibited by California law..

16. Changes to Terms

We may update these Terms at any time. The Effective Date above shows the current version. Continued use means you accept the changes.

 

16A. Privacy Policy Your use of the Site is also governed by our Privacy Policy. Because our store is hosted on Shopify Inc., certain personal information is processed through Shopify’s systems as part of providing our online store.
